INFORMATION ABOUT FLORIDA'S 3-DAY NOTICE FOR FAILURE TO PAY RENT FORM:
In order for to file a residential tenant eviction for possession because of non-payment of rent, Landlords must first issue a properly filled out 3-Day Notice in accordance with Florida Statutes. A major stumbling block for Landlords is the language used in their 3-Day Notices. I have seen Landlords create their own forms or, even worse, download forms off of the Internet that are not Florida specific. Florida Law requires that in order for the 3-Day Notice to be legally sufficient, it should be “substantially” similar to the form outlined in the Florida Statues. Another problem for Landlords is calculating the 3-day period in which the Tenants have the right to pay the rent or vacate the premises. Unfortunately for Landlords, “3-Days” does not necessarily mean “3-Days.” Landlords should contact an Eviction Attorney before erroneously filling out the 3-Day Notice. Moreover, even if the Landlord properly completes a legally sufficient 3-Day Notice, Landlords can still damage their case by incorrectly issuing the 3-Day Notice. An improperly filled out or issued 3-Day Notice is something that Tenants can use in defending the eviction. The drafting and issuing of a 3-Day Notice in accordance with Florida Law is something that you may be able to do own your own, but it is advisable for Landlords to seek the legal advice of an Eviction Attorney early in the eviction process, even before issuing the 3-Day Notice.
